In her valuable book Hiding from humanity: Disgust, shame and the law, Nussbaum says that she reaches many of the same practical conclusions as Mill. But she argues that Mill’s conceptions of liberty, justice, and respect for rival ideas of the good and for religious belief, are defective, and further that they do not provide as adequate a basis for the form of political liberalism she recommends. Actually, the alleged defects in Mill rest largely on misrepresentations, but more importantly, once (...) one understands the central role of Mill’s account of justice in shaping his view of liberty and morality, it becomes clear that he offers a better response to cultural pluralism. His way of relating the morality and the aesthetics of conduct embodies a kind of respect for diversity both deeper and more realistic than that claimed for political liberalism. Mill brings a heritage from the Enlightenment in the light of which political liberalism looks like a failure of nerve. M. MacDowell in the concluding paragraph of his article ‘Love versus the Law: an Essay on Menander's Aspis’. A similar view was already implicit in E. Health care begins as an act of conscience, which urges a response to the sick and holds caregivers accountable to moral standards that public authorities ultimately do not define. Conscience nonetheless expresses itself as a type of dialogue within oneself that is influenced by dialogue with others, especially with society in the form of civil law and professional standards. A well-formed conscience for health care relates the foundations of morality to health care practices and contributes sound moral judgment about them (...) to the common good. Some current health care policies and medical education presume a distorted view of conscience as personal sentiment. Hegel and Plato offer distinctive but related philosophical accounts of ethical absolutism, thereby suggesting that a comparative study of their ethical ideas will be valuable in clarifying their respective philosophical approaches, as well as in admitting a critical examination of the structure for and viability of two significant absolutist ethical standpoints. This paper will concentrate on evaluating their rival conceptions of the Good and related ethical doctrines as specific responses to their recognition of the need to secure ethical life against (...) the socially divisive effects of ethical controversy. This common inspiration of their ethical theorizing confirms the validity and significance of Williams' remarks on the significance of the consciousness of ethical variation cited earlier. Plato's and Hegel's elaborations of absolutist ethical positions, however, conflict with Williams' scepticism over whether there is an objective basis for ethics which is invoked in his Ethics and the Limits of Philosophy and his paper �The Truth in Relativism� to justify relativism, at least in regard to significantly divergent and diachronically distinct ethical practices. Ultimately, this paper will consider the extent to which the absolutist aspirations of Plato's and Hegel's ethical theories can be sustained in the light of the evident variation in ethical thought and practice. Li ke all good riddles the solution demands a paradigm shift. Nietzsche's riddle is solved by a radical rethinking of the concept of time, from a straight line to a circle. Donald Coxeter died in 2003, at a ripe old age of 96. Though I had regularly seen him at mathematics talks in Toronto for over twenty years, I never felt rushed to seek him out. It seemed he would go on forever. His death left me regretting my missed opportunity and Siobhan Robert's excellent book makes me regret it even more. Like any good biography of an intellectual, King of Infinite Space contains personal details and mathematical achievements in some detail. (...) Thus, we learn of the traumatic effects on Coxeter of his parents' divorce, his search for a spouse, his vegetarianism, and his progressive politics. We also learn a fair bit about the kaleidoscopes he made while in Cambridge during his student days in order to study the symmetry properties of polyhedra. These involved mirrors that Coxeter had specially constructed for this purpose. Along the way we are treated to interesting tidbits, such as G.H. Hardy's detestation of mirrors . There are brief accounts of the brilliant notation Coxeter invented, known as Coxeter diagrams, and of course, the now famous Coxeter groups. Short appendices fill in a bit more detail. Introduction to the Scientific Proof of the Natural Moral Law This paper proves that Aquinas has a means of demonstrating and deriving both moral goodness and the natural moral law from human nature alone. Aquinas scientifically proves the existence of the natural moral law as the natural rule of human operations from human nature alone. The distinction between moral goodness and transcendental goodness is affirmed. This provides the intellectual tools to refute the G.E. Moore (Principles of Ethics) attack against the (...) natural law as committing a "naturalistic fallacy". This article proves that instead Moore commits the fallacy of equivocation between moral goodness and transcendental goodness in his very assertion of a "naturalistic fallacy" by the proponents of the natural moral law. In the process the new deontological/kantian theory of natural law as articulated by John Finnis, Robert George, and Germain Grisez is false historically and philosophically. Ethical naturalism is affirmed as a result. (shrink)

In the Consolation of Philosophy, Lady Philosophy leads Boethius through a series of obstacles that prevent him from finding happiness within his prison cell: the role that luck and misfortune play in our affairs, the false paths to happiness in comparison with the true journey, the problem of evil and the disproportion between people’s lives and eschatological deserts, and, finally, whether God’s providential order necessitates our outcomes or if we can choose freely to pursue the happy life. As the pair (...) discuss each problem, the same argumentative move and countermove play out. Boethius, forgetful of what he had learned from Philosophy long ago on account of his grief, blames the very nature of reality itself for each of the problems that beset him. He thinks that Fortune has taken from him all that is good and that God’s providence only extends to the non-human world. Philosophy, by contrast, argues in each case that the problem at hand is, in fact, no problem at all when we see reality rightly. In each case, Philosophy shows that it isn’t reality that’s to blame for the problem at hand but instead human ignorance’s misunderstanding of the true nature of reality. Boethius’s conversation with Philosophy showcases a puzzling feature of self-knowledge: on the one hand, too much attention to the world (e.g., fortune’s wiles) is the problem and self-inquiry (e.g., the nature of one’s desires) is the solution, but on the other hand, too much attention to one’s self (e.g., attention to passions and limitations) is the problem and turning toward recognizing the true structure of the world is the solution. Philosophy seems to indicate that both poles are true, and the task is to determine how best to clarify how. After showcasing the dialogue’s argumentative pattern, I argue that, in Boethius’s case, each of his problems, as well as his misery in general, are caused by his ignorance and self-deception. Boethius’s ignorance is, in this case, the more proximate cause of his misery, but underlying his ignorance is an act of self-deception that causes him to be ignorant in the first place. As Philosophy tells Boethius early on, he already knows what she plans to teach him (more accurately, of what she plans to remind him). Nevertheless, he has forgotten what he has known and, as a result, is more the architect of his own misery than is Fortune or any of the events that have befallen him. Wounded by grief, he has allowed his affective response to his misfortune to becloud his understanding. As Philosophy says, he is unhappy because he has “forgotten what he is.” He has forgotten himself precisely because of the way in which he has allowed his affective responses to rule in his soul. Hence, while the ultimate cure for Boethius’s misery will be a newly rediscovered knowledge that reality itself is providentially structured, Philosophy must begin by soothing Boethius’s passions and undoing the damage that they have wrought on his understanding of the world. Philosophy cannot turn Boethius’s intellect until she has first turned his passions (cf. Republic 518b-d), which, while still wrongly-turned and governing the soul, are liable to lead to tremendous intellectual mistakes precisely because they are blind to the true nature of reality (cf. Phaedrus 247c). I argue in conclusion that the Consolation is unified by the theme of self-deception as the primary cause of philosophical misery. Boethius is upset primarily because he has convinced himself that he is otherwise than he is and that reality is otherwise than it is rather than because of what has happened to him, contrary to his own view of things. Philosophy’s argumentative strategy suggests that self-deception can only be undone by attending to it as a problem besetting the whole soul, not just the intellectual part of the soul. We thus have good warrant for thinking that simply rational responses to ignorance will be fruitless when ignorance is caused by or accompanied by a moral failing. (shrink)

Despite historic efforts to enact the Patient Protection and Affordable Care Act in 2010, national health reform is threatened by multiple legal challenges grounded in constitutional law. Premier among these claims is the premise that PPACA’s “individual mandate” is constitutionally infirm. Attorneys General in Virginia and Florida allege that Congress’ interstate commerce powers do not authorize federal imposition of the individual mandate because Congress lacks the power to regulate commercial “inactivity.” Stated simply, Congress cannot regulate individuals who choose not to (...) obtain health insurance because they are not engaged in a commercial venture. Several courts initially considering this argument have rejected it, but two federal district courts in Virginia and Florida have concurred, leading to numerous appeals and the near promise of United States Supreme Court review. 'Correlations without correlata' is an influential way of thinking of quantum entanglement as a form primitive correlation which nonetheless maintains locality of quantum theory. A number of arguments have sought to suggest that such a view leads either to internal inconsistency or to conflict with the empirical predictions of quantum mechanics. Here wew explicate and provide a partial defence of the notion, arguing that these objections import unwarranted conceptions of correlation properties as hidden variables. A more plausible account sees the (...) properties in terms of Everettian relative states. The ontological robustness of entanglement is also defended from recent objections. (shrink)

RésuméDans leur livre récent, George Lakoff et Rafael Núñez se livrent à une critique naturaliste soutenue du platonisme traditionnel concernant les entités mathématiques. Ils affirment que des résultats récents en sciences cognitives démontrent qu'il est faux. En particulier, ils estiment que la découverte que la cognition mathématique s'appuie pour une large part sur les métaphores conceptuelles est incompatible avec le platonisme. Nous montrons ici que tel n'est pas le cas. Nous examinons et rejetons également quelques arguments philosophiques que formulent Lakoff (...) et Núñez contre le platonisme. Enfin, nous lions leur hostilité au platonisme à certaines opinions sur les ramifications politiques de celui-ci. Pour conclure, nous faisons valoir que ces opinions sont sans fondements et présentent une image distordue des dimensions politiques du platonisme. (shrink)

At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

In May 2011, the clinical ethics group of the Center for Ethics at Washington Hospital Center launched a 40-hour, three and one-half day Clinical Ethics Immersion Course. Created to address gaps in training in the practice of clinical ethics, the course is for those who now practice clinical ethics and for those who teach bioethics but who do not, or who rarely, have the opportunity to be in a clinical setting. “Immersion” refers to a high-intensity clinical ethics experience in a (...) busy, urban, acute care hospital. During the Immersion Course, participants join clinical ethicists on working rounds in intensive care units and trauma service. Participants engage in a videotaped role-play conversation with an actor. Each simulated session reflects a practical, realistic clinical ethics case consultation scenario. Participants also review patients’ charts, and have small group discussions on selected clinical ethics topics. As ethics consultation requests come into the center, Immersion Course participants accompany clinical ethicists on consultations. Specific to this pilot, because participants’ evaluations and course faculty impressions were positive, the Center for Ethics will conduct the course twice each year. We look forward to improving the pilot and establishing the Immersion Course as one step towards addressing the gap in training opportunities in clinical ethics. (shrink)

Working within weak subsystems of second-order arithmetic Z2 we consider two versions of the Baire Category theorem which are not equivalent over the base system RCA0. We show that one version (B.C.T.I) is provable in RCA0 while the second version (B.C.T.II) requires a stronger system. We introduce two new subsystems of Z2, which we call RCA+ 0 and WKL+ 0, and show that RCA+ 0 suffices to prove B.C.T.II. Some model theory of WKL+ 0 and its importance in view of (...) Hilbert's program is discussed, as well as applications of our results to functional analysis. (shrink)

The seventeenth century was a period of extraordinary invention, discovery and revolutions in scientific, social and political orders. It was a time of expansive automation, biological discovery, rapid advances in medical knowledge, of animal trials and a questioning of the boundaries between species, human and non-human, between social classes, and of the assumed naturalness of political inequality. This book gives a tour through those objects, ordinary and extraordinary, which captivated the philosophical imagination of the single most important French philosopher of (...) this period, Rene Descartes. Deborah J. Brown and Calvin G. Normore document Descartes' attempt to make sense of the complex, composite objects of human and divine invention, consistent with the fundamental tenets of his metaphysical system. Their central argument is that, far from reducing all the categories of ordinary experience to the two basic categories of substance, mind and body, Descartes' philosophy recognises irreducible composites that resist reduction, and require their own distinctive modes of explanation. In a comparison of the principles of special relativity and of quantum mechanics, the former theory is marked by its relative economy and apparent explanatory simplicity. A number of theorists have thus been led to search for a small number of postulates - essentially information theoretic in nature - that would play the role in quantum mechanics that the relativity principle and the light postulate jointly play in Einstein's 1905 special relativity theory. The purpose of the present paper is to (...) resist this idea, at least in so far as it is supposed to reveal the fundamental form of the theory. It is argued that the methodology of Einstein's 1905 theory represents a victory of pragmatism over explanatory depth; and that its adoption only made sense in the context of the chaotic state state of physics at the start of the 20th century - as Einstein well knew. In this important book Peter G. Brown seeks to chart a new future for the species that share the earth. He offers an innovative, yet historically grounded, argument for human rights to bodily integrity; to moral, religious, and political choice; and to subsistence that all persons owe each other irrespective of nationality. He also argues that we have direct moral obligations to non-humans - he calls this 'respect for the commonwealth of life'. Honouring these obligations requires a thorough regrounding (...) of human institutions. Through a series of careful arguments the reader is shown: *How we could reconceptualise economics from a growth orientation to an economics of stewardship as a moral end.*How governments could be thought of as trustees to protect human rights and commonwealth of life.*How civil society could be organised and property rights reconceptualised in service of these objectives.The book concludes with the argument that traditional prerogatives of nation states need to be transparent to enforceable international standards concerning human rights and the commonwealth of life, and offers a practical agenda for beginning this fundamental reorientation. Continuing the investigations of X. Yu and others, we study the role of set existence axioms in classical Lebesgue measure theory. We show that pairwise disjoint countable additivity for open sets of reals is provable in RCA0. We show that several well-known measure-theoretic propositions including the Vitali Covering Theorem are equivalent to WWKL over RCA0.

Properties sometimes attributed to the “particle” aspect of a neutron, e.g., mass and magnetic moment, cannot straightforwardly be regarded in the Bohm interpretation of quantum mechanics as localized at the hypothetical position of the particle. This is shown by examining a series of effects in neutron interferometry. A related thought-experiment also provides a variation of a recent demonstration that which-way detectors can appear to behave anomolously in the Bohm theory.
